The class action lawsuit alleges that under the California Labor Code, Mercer Health & Benefits Administration is required to pay all persons employed in the job position of Client Advisor overtime wages for their time worked in excess of eight hours in a workday and hours worked in excess of forty hours in any workweek. The class action complaint further asserts that the Client Advisors employed by Mercer Health in California were allegedly misclassified because these employees failed to meet all the criteria under any of the exemptions to overtime pay in California. Specifically, the Complaint claims these employees engaged in the finite set of tasks of answering client calls for service related issues, sending out insurance applications when requested, calling and emailing insurance carriers, preparing certificates of insurance, inputting data for new and renewal insurance applications, processing insurance applications, and performing other clerical and customer service and sales related tasks. As a result, the Complaint requests that these employees should be paid for all the overtime hours they have worked for Mercer.
